Terms of Service

1. Agreement & Operator

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," "User") and U. Genc, doing business as Patara (an unincorporated sole proprietorship) ("we," "us," "our," "Operator"), governing your use of the Passage mobile application and any related websites, services, and content (collectively, the "Service").

Patara is not a registered company. All legal obligations, liabilities, and responsibilities under these Terms rest with U. Genc as the sole operator.

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction, such as 16 in certain EU member states) to use the Service. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. The Service

Passage is a language-learning application that enables users to read literary works in various languages, receive AI-assisted grammar tips and explanations, save vocabulary, and practise through exercises including flashcards, context recall, listening exercises, and word-matching games.

The Service is provided for personal, non-commercial, educational use only. You may not use the Service, or any content available through the Service, for commercial purposes without our prior written consent.

4. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us promptly of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable prior notice where practicable.

5. Subscriptions & Payments

Passage may offer free and paid subscription tiers. If you purchase a subscription:

• Billing: Payment is processed through the Apple App Store or Google Play Store (collectively, "App Store Providers"). All billing is subject to the respective App Store Provider's terms and policies.
• Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date through your App Store Provider's subscription management.
• Refunds: Refund requests are handled by your App Store Provider in accordance with their refund policies. We do not directly process payments or issue refunds.
• Price changes: We may change subscription prices. You will receive advance notice, and continued use after a price change constitutes acceptance.

6. Book Content & Public Domain Works

Passage provides literary works that are not restricted by U.S. copyright law. Regarding this content:

• No third-party project affiliation: The texts in Passage are presented independently. All third-party project names, trademarks, headers, footers, and license notices have been removed from the texts. Passage is not affiliated with, endorsed by, or sponsored by any third-party digitisation project, archive, or library. No such project's trademark or name is used in connection with the texts we provide.
• No copyright claim on underlying texts: We do not claim copyright ownership over the underlying public domain text of any literary work.
• Our value-added content is protected: All modifications, annotations, grammar tips, translations, formatting, selection, arrangement, user interface design, and supplementary educational content created by or for Passage are the intellectual property of the Operator and are protected by applicable copyright and intellectual property laws.
• International copyright responsibility: You are solely responsible for determining whether the literary works accessed through Passage are in the public domain in your jurisdiction. We make no representation or warranty regarding the copyright status of any work outside the United States. If you are located outside the United States, you assume all risk related to copyright compliance in your jurisdiction.
• Derivative works: Our presentation of these texts, together with our annotations, formatting, and educational content, constitutes derivative or compiled works. You may not copy, redistribute, or commercially exploit our specific presentation, layout, annotations, or supplementary content.

7. AI-Generated Content — Disclaimer

You acknowledge and agree that:

• AI-generated content is provided "as is" for educational and informational purposes only and does not constitute professional language instruction, certified translation, or academic advice.
• AI-generated content may contain errors, inaccuracies, omissions, or misleading information. Language is inherently complex, and AI systems may not capture all grammatical nuances, dialectal variations, regional usage, or contextual subtleties.
• You are solely responsible for evaluating and verifying the accuracy, reliability, and suitability of any AI-generated content before relying on it for any purpose, including but not limited to academic work, professional translation, or official communication.
• We do not warrant or guarantee the accuracy, completeness, reliability, currentness, or fitness for any particular purpose of any AI-generated content.
• AI-generated content should not be used as a substitute for professional language tutoring, certified translation services, or qualified linguistic advice.
• The Operator disclaims all liability for any loss, damage, or harm arising from your reliance on AI-generated content, to the fullest extent permitted by applicable law.

8. Intellectual Property

8.1 Our Intellectual Property

The Service and its original content (excluding public domain literary texts), features, functionality, design, graphics, logos, icons, and software are and shall remain the exclusive property of the Operator. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

8.2 Your Content

You retain ownership of any content you create within the Service (e.g., personal notes, word lists). By using the Service, you grant us a limited, non-exclusive license to store and process your content solely for the purpose of providing and improving the Service.

8.3 Feedback

If you provide feedback, suggestions, or ideas regarding the Service, you grant us a non-exclusive, worldwide, royalty-free, irrevocable license to use, modify, and incorporate such feedback into the Service without obligation or compensation to you.

9. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the app.
• Copy, redistribute, sell, license, or commercially exploit the content provided through the Service (including book texts as presented, grammar tips, and other educational content).
• Use automated systems (bots, scrapers, crawlers) to access or extract content from the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Impersonate any person or entity, or misrepresent your affiliation.
• Use the Service to develop a competing product or service.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE OPERATOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The content (including AI-generated grammar tips and public domain texts) will be accurate, complete, reliable, or current.
• The Service will meet your specific requirements or expectations.
• Any defects or errors will be corrected.
• The literary works available in the Service are in the public domain in your jurisdiction.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply only to the extent permitted by applicable law. If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, your statutory rights are not affected by this section.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, U. GENC, D/B/A PATARA, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use the Service.
• Any content provided through the Service, including AI-generated grammar tips, translations, or explanations.
• Any reliance on the public domain status of literary works outside the United States.
• Unauthorised access to or alteration of your data.
• Any third-party conduct or content on the Service.
• Any other matter relating to the Service.

THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO THE OPERATOR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In such jurisdictions, the Operator's liability shall be limited to the fullest extent permitted by applicable law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Operator and their agents, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property rights.
• Your violation of any applicable law or regulation.
• Any content you submit or transmit through the Service.

This indemnification obligation shall survive the termination of these Terms and your use of the Service. If you are a consumer in the EEA/UK, this clause applies only to the extent permitted by applicable consumer protection law.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination:

• Your right to use the Service ceases immediately.
• We may delete your account and associated data in accordance with our Privacy Policy.
• Provisions that by their nature should survive termination shall remain in effect, including Sections 6 through 12, 14, and 16.

You may terminate your account at any time by deleting your account through the app settings or by contacting us. Termination does not entitle you to a refund of any prepaid subscription fees, except as required by applicable law or the policies of your App Store Provider.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may submit the dispute to the competent courts in the Netherlands.

For EU consumers: If you are a consumer residing in the European Union, you may also make use of the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Nothing in these Terms affects your right to bring proceedings in the courts of your country of residence as permitted by applicable law.

15. Third-Party Services & Apple/Google Terms

15.1 App Store Providers

You acknowledge that these Terms are between you and the Operator only, and not with Apple Inc., Google LLC, or any other App Store Provider. The App Store Provider is not responsible for the Service or its content. To the extent required by the App Store Provider's terms:

• The App Store Provider has no obligation to furnish any maintenance or support services with respect to the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify the App Store Provider, and the App Store Provider may refund any applicable purchase price. To the maximum extent permitted by law, the App Store Provider has no other warranty obligation with respect to the Service.
• The App Store Provider is not responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• The App Store Provider is not responsible for the investigation, defence, settlement, or discharge of any third-party intellectual property infringement claim related to the Service.
• Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms (to the extent the Service is distributed via the Apple App Store), and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

15.2 Third-Party AI Services

The AI-powered features of the Service may utilise third-party machine-learning and AI services. Your use of these features is also subject to the terms and privacy policies of those third-party providers. We are not liable for the performance, accuracy, or availability of any third-party AI service.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Operator regarding the use of the Service. These Terms supersede any prior agreements or communications between you and the Operator regarding the Service.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such term or any other term, and the Operator's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Provide notice through the app, by email, or by other reasonable means.
• Where required by applicable law, seek your renewed consent.

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and may delete your account.
